Terms of Service

These Terms of Service govern your access to and use of the muqawil (مقاول) construction management platform. By creating an account or using the platform, you agree to these terms.
1. Who we are
muqawil (مقاول) is a bilingual construction management platform for contractors across the Arab world. The platform is operated by muqawil (the "Company", "we", "us").
2. Your account
To use the platform you must register an account on behalf of a company ("tenant"). You are responsible for:
- Keeping your sign-in credentials confidential and enabling two-factor authentication for admin users.
- All activity that happens under your tenant, including activity by teammates you invite.
- Ensuring the information you submit (project, worker, financial data) is accurate and that you have the right to process it.
3. Free trial and paid subscription
New tenants get a 7-day free trial of the muqawil Pro plan, no credit card required. After the trial, continued access requires an active paid subscription at the price shown on the pricing page. Subscriptions renew monthly until cancelled.
4. Acceptable use
You agree not to use the platform to violate any law, infringe anyone's rights, upload malware, attempt to access another tenant's data, reverse-engineer the service, or use it to send unsolicited communications. We may suspend tenants that materially breach this section.
5. Your content
You retain ownership of all data you upload (projects, drawings, photos, reports, worker records). You grant us a limited licence to host, process, back up and display that data solely to provide and improve the service. We will not sell your content, and we will not use it to train AI models without your written agreement. You are responsible for:
- Having a lawful basis to upload personal data of workers and teammates.
- Backing up critical records — while we maintain backups, the platform is not a system of record for regulatory archives.
- Removing content that violates these terms when we notify you.
6. Service availability
We aim for 99.5% monthly uptime measured outside scheduled maintenance windows. The platform is provided on a commercially reasonable basis without an SLA on the standard Pro plan; bespoke uptime commitments are available on enterprise contracts.
7. Fees, taxes, and refunds
Subscription fees are billed in advance each month and are non-refundable except where required by law. You are responsible for any taxes (VAT, GST, withholding) applicable in your jurisdiction. We may change pricing with at least 30 days' notice; changes take effect on your next renewal.
8. Termination
You can cancel your subscription at any time from the billing screen. We can suspend or terminate your account for non-payment, material breach of these terms, or extended inactivity. After termination you have 30 days to export your data; after that we may delete it.
9. Disclaimers and limitation of liability
The platform is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, our aggregate liability for any claim arising out of the service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages.
10. Governing law
These terms are governed by the laws of the jurisdiction in which the tenant is registered. Disputes will be resolved through good-faith negotiation before any litigation or arbitration.
